Right of Withdrawal (Ångerrätt)

1. Your Withdrawal Right Under EU Law
1.1. Under the EU Consumer Rights Directive (2011/83/EU), as implemented by Swedish law (Lag (2005:59) om distansavtal och avtal utanför affärslokaler, "Distansavtalslagen"), consumers have the right to withdraw from a distance purchase within fourteen (14) days without giving any reason.
1.2. This right applies to purchases of Brain OS software licenses made through brainos.wallinsolutions.se.
2. Why the Withdrawal Right Was Waived at Checkout
2.1. At the time of your purchase, you were asked to check a box with the following text:
"I consent to immediate delivery of the digital license and acknowledge that I thereby lose my 14-day right of withdrawal."
2.2. By checking that box, you explicitly:
(a) Consented to immediate delivery of the digital content (the license key) before the expiry of the 14-day withdrawal period; and
(b) Acknowledged that by giving such consent, the right of withdrawal is lost.
2.3. This is permitted under Article 16(m) of the Consumer Rights Directive and Chapter 2, Section 11 of Distansavtalslagen. The withdrawal right is lost when both conditions in 2.2 are met.
2.4. Your consent was recorded at the time of purchase, including the timestamp, your IP address, and the context of the transaction. A confirmation was provided to you on a durable medium (the checkout confirmation page and/or email).
3. Brain OS Offers Full Evaluation Before Purchase
3.1. Brain OS provides a free tier with no time limit that includes every feature of the software. The only difference between the free tier and paid tiers is the number of disks supported:

- Install and run Brain OS on your hardware for as long as you wished;
- Test all features — Docker apps, GPU passthrough, VPN, encryption, parity, caching, and everything else;
- Verify compatibility with your hardware;
- Evaluate the user interface, performance, and reliability.
3.3. Your paid license unlocks additional disk capacity on the exact same software you already tested. No features change, no new software is delivered — only the disk limit is raised.
4. If You Believe the Product Does Not Conform
4.1. Under the Swedish Digital Content Act (Lag (2022:260) om digitalt innehåll), you have the right to a conforming product. If you believe the software does not conform to what was agreed (for example, the paid license does not unlock the promised number of disks), you may be entitled to:
(a) Rectification — we fix the issue at no cost to you;
(b) Price reduction — proportional to the defect;
(c) Termination of the contract — in cases of significant non-conformity.
4.2. To report a conformity issue, contact us at robban@wallinsolutions.se with:
- Your license key (e.g., BRAIN-PRO-XXXX-XXXX)
- A description of the issue
- What you expected vs. what happened
4.3. We will respond within 14 days and work to resolve the issue promptly.
5. Dispute Resolution
5.1. If you are not satisfied with our response, you have the following options:
For consumers in Sweden
- Konsumentverket (Swedish Consumer Agency): www.konsumentverket.se
- Allmänna reklamationsnämnden (ARN) (National Board for Consumer Disputes): www.arn.se — free dispute resolution for consumers. Note that ARN has minimum thresholds for the value in dispute.

For consumers in the EU
- EU Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr — submit a complaint online in any EU language.
Legal proceedings
- Disputes are governed by Swedish law and shall be resolved by Swedish courts. The court of first instance is Stockholms tingsrätt (Stockholm District Court), unless mandatory consumer protection law requires otherwise.
